At Colmenares & Asociados, we firmly believe that Intellectual Property is an essential tool for economic, social, and cultural development. It provides legal certainty, strengthens the value of intangible assets, and opens new opportunities for growth for individuals, communities, entrepreneurs, cultural associations, and organizations committed to art and innovation.

In a context marked by financial challenges and rapid technological advances, we reaffirm our vocation of service to those sectors facing difficulties in managing and protecting their creations. In response to this reality, our firm’s Pro Bono Area brings legal support closer to those who transform their surroundings through their creative work.

With over 120 years of experience in the practice of Intellectual Property, we are committed to delivering high-quality professional advice. In its first year of operation, the Pro Bono Area has set a goal of providing at least 50 hours of legal assistance, thus expanding the opportunities for beneficiaries to take their projects into new spaces of creation, identity, and progress, reinforcing the transformative impact of their initiatives within their communities.

This effort is led by our Pro Bono Committee, comprised of Luis Gayoso Frayssinet, Guillermo Melgarejo Zorrilla, Diego Pozo Córdova, and Manuel Fernández-Stoll Zar, who guide this initiative with the highest professional standards. A notable example of this commitment is the training provided to the Shipibo-Konibo community of Cantagallo—an extraordinary community of artists—on the use of legal tools to protect and add value to their cultural expressions, as well as the support given in registering the artwork Designs of Our River, by renowned visual artist Harry Pinedo.

The Port of Chancay in Peru: Economic boost and challenges in industrial property rights management

Guillermo Melgarejo Zorrilla, of Estudio Colmenares & Asociados SAC, analyzes the economic and regulatory implications of the potential transformation of Peru into the main port hub in Latin America and how this constitutes a challenge in industrial property rights management.

On September 4, 2023, media attention in Peru focused on the arrival of the largest vessel ever recorded on its coasts, we are talking about the CMA-CGM Alexander Von Humboldt, with a length of 400 meters and a cargo capacity of 186 thousand tons, equivalent to 16,000 TEUs (20-foot containers). This event marked a transcendental milestone in the country’s port history.

Since then, news about port infrastructure projects has continued to emerge, attracting the attention of not only countries in the region, but also the international community. The current construction of the Chancay Multipurpose Port Terminal, located 75 km north of Lima, aims to position Peru as the main port and logistics hub in Latin America. This terminal, still under development, will have the capacity to facilitate the distribution of cargo from Asia to various countries such as Chile, Ecuador and Colombia, thus boosting the dynamics of foreign trade.

According to statistics provided by the Ministry of Transportation and Communications (MTC) of Peru, the projected investment to make the Chancay Port Terminal operational is estimated at US$3.6 billion. Its inauguration is scheduled for November 2024 and the presence of Chinese President Xi Jinping has been confirmed, who will also attend the Asia-Pacific Economic Cooperation (APEC) Summit to be held in Peru.

Although positive growth is forecast in the commercial and port sector in Peru, it is necessary to recognize that simultaneously with the increase in the trade-driven economic activity and the potential increase in imports and exports, phenomena that could have negative repercussions for the collective interest, consumers and rights holders will also intensify. Specifically, the infringement of industrial property rights emerges as a concern that could worsen if it is not addressed through adequate state policies and laws that are coherent, practical and efficient in their application.

Various regulations govern in Peru whose objective is to protect industrial property rights. In relation to customs clearance operational processes, there is Legislative Decree No. 1092, Border Measures Law, and its respective Regulations, whose purpose is the protection of copyright, related rights and trademark rights. The aforementioned regulation makes it possible to suspend the clearance of goods destined for import, export or customs transit regimes when their pirated or counterfeit origin is presumed. The Customs Authority will be effective in the application of its control power, based on the information that the owner of a right must previously register in the voluntary registry that is a data platform from which the existence of the infringed right can be identified and timely issue alerts so that the owners or their representatives can take the respective legal actions.

In turn, Legislative Decree No. 1607, published in December 2023, brought important modifications to Law No. 30077, Law against Organized Crime. This change expanded the scope of action of the legislation to include customs crimes and crimes against intellectual rights. Now, criminal organizations dedicated to smuggling, undervaluation of merchandise and intellectual property crimes may be investigated and prosecuted under these regulations. This modification does not diminish the powers of the Specialized Prosecutor’s Office for Customs Crimes and against Intellectual Property, the institution traditionally in charge of these cases, but now also empowers the intervention of the Specialized Prosecutor’s Office against Organized Crime. This last entity currently has greater economic resources and specialized professionals, thus strengthening the State’s capacity to pursue and process complex crimes in the customs and intellectual property fields. This change reflects a more comprehensive and efficient approach in the fight against highly complex criminal activities.

Likewise, since July 5, 2023, Peru has had an Artificial Intelligence (AI) Law, Law No. 31814, marking a significant milestone in its efforts to promote economic and social development through the improvement of procedures in public services. This legislation seeks to take advantage of the capabilities of AI to optimize the efficiency and effectiveness of various areas, being a clear example of the public customs administration. It should be noted that the push towards technological approaches in customs management is not a recent phenomenon, since, in 2021, Customs had begun the implementation of the Smart Borders program, which incorporates the use of emerging technologies to improve customs control operations. Therefore, the Artificial Intelligence legislation adds to and reinforces pre-existing initiatives, consolidating the country’s commitment to modernizing its processes to strengthen the customs sector.

It could be considered then that the existing legislative structure in Peru would be in a position to guarantee respect for industrial property rights in the face of the potential growth of the port sector and the substantial increase in foreign trade, however, in parallel to the efforts of authorities, economic actors also emerge who, with a high degree of sophistication, infringe industrial property rights by deploying increasingly elaborate strategies, managing to evade customs control. Given this scenario, a constant evaluation of the legislation and the implementation of proactive measures are required. Likewise, it is imperative to strengthen customs control and surveillance mechanisms, taking advantage of the technological tools available to effectively counteract infringements of industrial property rights.

In conclusion, the continuous improvement of the legislative structure and the application of innovative measures are essential to address constantly evolving challenges in the customs process environment. The notable growth of foreign trade activities requires the urgent need to adapt and strengthen legislation, thus guaranteeing a legal framework that promotes the adequate protection of industrial property rights in a dynamic and changing context.

Difference Between Invention Patent and Utility Model

Invention Patents protect products and processes that meet the inventive step requirement, meaning they solve a technical problem that had not been resolved before. Utility Model Patents only protect a new shape introduced to an object that provides a new function or technical advantage over previous creations. Utility Models do not require an inventive step analysis like invention patents; it is enough to show that the new form granted to the claimed product confers a technical advantage over what is already known in the prior art.

Utility Models

Utility Models are intended to protect any new form, configuration, or arrangement of elements in any device, tool, instrument, mechanism, or other object—or part thereof—that allows better or different functioning, use, or manufacture of the object, or provides some utility, advantage, or technical effect not previously present (Decision 486 – Art. 81).
Only product claims can be protected in this category, with novelty and technical advantage being the key criteria.

Designs

Designs protect the particular appearance of a product that results from any combination of lines or colors, or from any two-dimensional or three-dimensional external shape, contour, configuration, texture, or material, without changing the product’s purpose (Decision 486 – Art. 113).
Designs must primarily meet the novelty criterion. The Peruvian Patent Office does not conduct a novelty examination ex officio, unless the design clearly lacks novelty or if an opposition is filed during the registration process (Article 124 of Decision 486).

The trademark registration system in the Andean Community has evolved over time, allowing both oppositions to improper registrations and the possibility of registering trademarks in multiple classes. This article explores the right of opposition under Decision 486 and the adoption of the multi-class trademark system within the region.

The Right of Opposition in Trademark Registration

The right of opposition allows any person with a legitimate interest to prevent the registration of a trademark if they believe it infringes on their rights. According to Article 147 of Decision 486, owners of identical or similar trademarks in member countries can file oppositions when the use of a trademark may mislead the public. For an opposition to be valid, the opponent must demonstrate their interest in operating in the market of the country where the opposition is filed and, in many cases, must submit a registration application for the disputed trademark.

Types of Opposition

Based on a previously registered trademark:
If a trademark is already registered in any member country, the trademark office may reject a new registration application that conflicts with the existing one.

Based on a prior registration application:
If the opposition is based on a previously filed application in a member country, the trademark office will suspend the second trademark registration until the first application is resolved.

Deadlines and Requirements for Filing an Opposition

If an opposition is filed, the national office will notify the applicant, who will have 30 days to respond and provide evidence. At the request of the interested party, this period may be extended once for an additional 30 days.

Cases Where Opposition Is Not Accepted

The trademark office will reject an opposition if:

It does not contain essential information about the opponent or the challenged application.

It is filed after the deadline.

The corresponding fees have not been paid.

Multi-Class Trademark Registration: A Growing Trend

Traditionally, trademark registrations followed a single-class system, meaning each application could only apply to one category of goods or services. However, with the adoption of Decision 689, multi-class trademark registration was introduced, allowing applicants to include multiple classes within a single application.

Characteristics of the Multi-Class System

Applicants can register goods and services in multiple classes under a single application.

It is necessary to clearly specify which goods and/or services will be protected, grouping them according to the Nice International Classification.

A multi-class application can be divided into multiple individual applications during the registration process while retaining the original filing date.

This change was driven by Peru’s obligation to adhere to the 1994 Trademark Law Treaty as part of the Trade Promotion Agreement (TPA).

Comparison with International Legislation

Different countries have adopted different approaches to trademark registration:

Chile: Only allows applications for specific products or services, indicating the corresponding class.

European Union: Allows applications for all 42 classes of the Nice International Classification, with a base fee covering the first three classes and an additional fee for extra classes.

Mexico: Does not explicitly establish a single-class system, meaning multi-class applications are generally allowed.

Why Is the Transition to the Multi-Class System Important?

The single-class system was incompatible with global trends in trademark protection, leading to its gradual modernization in the Andean region. The adoption of the multi-class system:

✔ Facilitates trademark management
✔ Reduces administrative costs and processing times
✔ Aligns Andean legislation with international standards

Conclusion

The right of opposition and the adoption of multi-class trademark registration represent significant advancements in trademark law within the Andean Community. While the former protects the rights of trademark owners against improper registrations, the latter modernizes the system, making it more efficient for protecting trademarks across multiple industries.
